Global Outsourcing Client Alert: 2005

Looking back over 2005, it is interesting to note how
much has changed, and how much has stayed the same. On the legislative
front, the year in the United States began with a
continued stream of “global sourcing” bills at both federal
and state levels. As reported in
the May issue of Outsourcing LegalBytes, over 112 bills to condition
or restrict outsourcing were introduced in at least 40 states during
the first three months of the year.At the federal
level, we witnessed a tightening up of the L-1 Visa law (January
issue of Outsourcing LegalBytes), and a proposal to regulate the
offshoring of personally identifiable health and financial information
(April issue), among other developments. Then came ChoicePoint
and several other widely reported security breaches. State after
state responded by following California to enact laws that require
companies to disclose security breaches, and to provide additional
protections for financial and other personal information.A similar
bill
was introduced at the federal level.
